Special Investigations unit claims (SIU) and Insurance Fraud
Hodges Walsh and Slater LLP represent several insurers who seek our counsel and guidance on a varied and diverse number of claims involving First and Third party Fraud issues. Our counsel work closely with claims personnel assisting in the detailed investigation of these claims where we are called upon to conduct Examinations under Oath and provide legal opinion and counsel on the issues presented.
Our attorneys are frequently called upon to provide such counsel and guidance to our clients regarding the obligations of insurance companies and their insured's in the face of claims of fraud, misrepresentation, lack of cooperation and numerous other related issues. We often serve as counsel both for the plaintiff and the defendant in numerous declaratory judgment actions where we affirmatively seek equitable relief and damages for our clients.
Hodges Walsh and Slater LLP provide continuous training to various SIU departments throughout New York State on a wide variety of issues involving these claims.
Recently, Harold L. Moroknek, a member of the firm, was asked by the Torts, Insurance and Compensation Law Section of the New York State Bar Association to lecture as a part of the Law School for Insurance Professionals program. Mr. Moroknek lectured to audiences of insurance professionals in Long Island and New York City on the topic entitled "Addressing Fraud in First and Third Party Claims, How to Identify, Investigate and Protect Yourself."
Additionally, Mr. Moroknek recently provided training to the SIU department of a nationally recognized insurance company on the topic of How to conduct a “proper” examination under oath (EUO) and also recently participated in training of the members of the New York State Police Investigators Association on the issue of “Garrity” rights, appropriate investigation and insurance fraud.
